These Terms of Service govern your use of mahermotors.net and purchases from Maher Motors. By visiting the site, creating an account, or placing an order, you agree to these Terms and to the policies referenced here. If you do not agree, do not use the site or place an order.

The store is operated by Maher Motors and hosted by Shopify. References to "we," "us," and "our" mean Maher Motors.

1. Eligibility and lawful use

You must be at least the age of majority in your place of residence, or use the site with the permission of a parent or legal guardian. You may use the site only for lawful purposes. You may not interfere with site operation, bypass security, introduce malicious code, scrape the site in a manner that impairs service, misuse another person's information, or use our content or services to violate any law or third-party right.

2. Product information and fitment

We work to provide accurate descriptions, photographs, part numbers, application notes, specifications, and availability. Automotive catalogs and manufacturer data can contain errors, supersessions, production-date splits, regional differences, and option-dependent fitment. Images may be representative, and packaging or minor product details may change without notice when the function and specification remain equivalent.

You are responsible for reviewing the complete listing, part number, vehicle year, make, model, engine, drivetrain, options, production date, and applicable manufacturer service information before purchase and installation. Any year/make/model, specification, VIN, cross-reference, or search tool is provided as an aid and is not a guarantee of fitment. When uncertain, contact us before ordering.

Vehicle manufacturer names, logos, and part numbers are used only for identification and compatibility reference. Unless a listing expressly states otherwise, Maher Motors is an independent seller and is not affiliated with, sponsored by, or endorsed by Mercedes-Benz Group AG, BMW AG, Volkswagen AG, Audi AG, Dr. Ing. h.c. F. Porsche AG, or any other vehicle manufacturer.

3. Genuine, OEM, aftermarket, and repackaged products

Product classification is stated in the listing. "Genuine" generally means branded or supplied through the vehicle manufacturer's parts channel; "OEM" or "OE supplier" does not necessarily mean vehicle-manufacturer packaging; "aftermarket" means produced outside that channel. Manufacturer names and part numbers do not by themselves indicate the source or classification of an item.

When a genuine workshop product is divided into smaller service quantities, the listing will disclose that it was repackaged by Maher Motors and identify which packaging or accessories are not original manufacturer retail packaging. The product should be evaluated according to that disclosure before purchase.

4. Orders and acceptance

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not guarantee acceptance. We may accept, reject, limit, or cancel an order before shipment for reasons including payment authorization, suspected fraud or resale abuse, stock or supplier issues, shipping restrictions, obvious pricing or catalog errors, or inability to verify required information.

If we cancel an order after payment, we will refund the amount collected for the canceled item or order. We may limit quantities per customer, household, business, payment method, or address. Products and offers may be changed or discontinued without notice.

5. Prices, payment, and taxes

Prices are shown in the currency indicated at checkout and may change without notice. Taxes, shipping, duties, brokerage, and other charges are added where applicable. You agree to provide current, complete, and accurate billing and account information and represent that you are authorized to use the selected payment method.

We may correct obvious typographical, pricing, discount, availability, or product-information errors, including after an order is submitted. If a correction materially affects an unshipped order, we will cancel and refund it or contact you for approval where practical.

6. Shipping, cancellation, returns, and refunds

Our Shipping Policy and Return and Refund Policy are incorporated into these Terms. Delivery dates are estimates unless expressly guaranteed in writing. A change or cancellation is not guaranteed after fulfillment begins. Once an order is packed, fulfilled, or accepted by a carrier, the applicable return process governs.

7. Installation, service information, and safe use

Automotive parts and service products can cause injury, property damage, or vehicle failure if selected, handled, stored, or installed incorrectly. Follow current vehicle and product manufacturer instructions, warnings, torque specifications, safety procedures, environmental rules, and maintenance schedules. Use appropriate protective equipment and a qualified technician when the work exceeds your tools, training, or experience.

Guides, articles, videos, answers, and product notes on the site are general information, not a substitute for the factory service procedure, professional diagnosis, or inspection of the specific vehicle. Stop work and seek qualified assistance when conditions differ from the guide or safe completion is uncertain.

8. Warranties and claims

Products may carry a manufacturer warranty as stated in the listing or warranty materials. Warranty claims are subject to verification and may require return of the product, proof of purchase, vehicle and installation information, diagnostic documentation, and inspection. Damage caused by incorrect fitment, installation error, misuse, modification, contamination, misdiagnosis, racing or off-road use unless expressly approved, or failure of another component is not a product defect.

Except for express warranties stated in writing and any warranties that cannot lawfully be excluded, the site, its content, and products are provided on an "as available" basis. We do not promise that the site will be uninterrupted or error-free or that every product description, cross-reference, or compatibility note will be complete in every circumstance.

9. Limitation of liability

To the fullest extent permitted by law, Maher Motors and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, or for labor, diagnosis, towing, storage, rental vehicles, loss of use, vehicle downtime, lost profits, or damage caused by another component.

To the fullest extent permitted by law, our aggregate liability arising from a product, order, or use of the site will not exceed the amount you paid Maher Motors for the product giving rise to the claim. These limitations do not apply to liability that cannot lawfully be limited, including where applicable liability for gross negligence, willful misconduct, or personal injury caused by conduct for which exclusion is prohibited.

10. Accounts, reviews, and submitted content

You are responsible for safeguarding account credentials and for activity under your account. Notify us promptly of suspected unauthorized use.

If you submit a review, image, suggestion, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not violate another person's rights. You grant Maher Motors a nonexclusive, worldwide, royalty-free license to use, reproduce, edit for length or formatting, and display that content in connection with our business. We may remove content that is deceptive, abusive, unlawful, irrelevant, or contains private information.

11. Intellectual property and third-party services

Maher Motors site design, original text, graphics, photographs, guides, and branding are owned by Maher Motors or used with permission and may not be copied, republished, or commercially exploited without written permission. Third-party trademarks remain the property of their owners.

The site may use or link to services operated by Shopify, payment processors, carriers, manufacturers, and other third parties. Their separate terms and privacy practices may apply. We are not responsible for third-party sites or services outside our control, but this does not limit obligations we have under applicable law for your order.

12. Indemnification

To the extent permitted by law, you agree to reimburse Maher Motors for reasonable losses, liabilities, and costs arising from your unlawful use of the site, your material breach of these Terms, or your violation of another person's rights. This section does not require a consumer to indemnify us for our own negligence or misconduct.

13. Changes, severability, and waiver

We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively. Terms in effect when an order is accepted will continue to govern that order unless a change is required by law.

If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will remain in effect. A delay in enforcing a provision is not a waiver.

14. Governing law

These Terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-law rules. Nothing in these Terms removes any mandatory consumer protection or venue right that applies to you.
